Gross Misdemeanor DUI/DWIs does not mean automatic jail

Friends, I just finished representing a very nice woman who was charged with “Second Degree DUI”, which is a gross misdemeanor. Such a crime carries up to 1 year in jail and up to $3,000.00 in fines.  My client was not only allegedly intoxicated, but she had a minor child in the car (that’s two big strikes in the system).

With very good maneuvering, having my client obtain her own chemical assessment and do a variety of other “tasks”, my client was sentenced to:  NO JAIL.  NO COMMUNITY SERVICE (often called STS) and received a modest $450.00 fine.  The right attorney with the right education, makes all the difference in the world.  Any attorney can hold a client’s hand and plead them guilty.  Make sure you hire an attorney who is not afraid the push the envelope and has a “bag of tools” to help minimize the outcome of a criminal/traffic charge.
